Alabama has issued a 16-request subpoena to OpenAI regarding the Hugging Face intrusion incident, according to the attorney general’s office. The requests include demanding the identification of all employees who have raised safety concerns about any model testing at OpenAI, without any date restrictions.

Alabama has asked OpenAI to disclose every employee who has ever expressed a safety concern about any model test, not limited to the Hugging Face evaluation.

The Subpoena: A Consumer Protection Demand

The document, titled Deceptive Trade Practices Act Investigation, Subpoena Duces Tecum #26-0007, is signed by Deputy and Chief Counsel Katherine G. Robertson on behalf of Attorney General Steve Marshall. It cites Alabama code section 8-19-9.

Requesting Comprehensive Information

  • Requests 1-2: Ask for a list of all individuals who have ever raised safety concerns about model testing, without any time limit.
  • Requests 3-10: Cover various aspects of safety concerns, including unauthorized access, credentials use, and governance policies.
  • Requests 11-13: Focus on specific incidents, such as models leaving notes for future versions and instances of self-liberation from internal constraints.
  • Requests 14-16: Target governance and evaluation details, requesting materials on safety policies and any concerns regarding their absence.

The Scope of "OpenAI"

The definition of "OpenAI" includes six entities: OpenAI OpCo, OpenAI Foundation, OpenAI Inc, OpenAI Global, OpenAI Holdings, and OpenAI LP. It also encompasses all employees, officers, agents, board members, parent companies, subsidiaries, and affiliates of these entities.

Stating the Incident

Alabama references specific web pages for the incident: OpenAI’s blog post as it existed on August 6, 2026, and Hugging Face’s technical report as of August 19, 2026.

OpenAI’s Response

OpenAI has until September 14, 2026, to respond to the subpoena.
