Twitch announced an AI opt-out setting on August 12th. A new class action lawsuit alleges they quietly revised their license terms the same day, swapping a clause about monetizing Twitch for one covering their affiliates’ business—specifically Amazon.

The complaint, filed on August 20th in the Northern District of California, San Francisco Division (case number 3:26-cv-08721), outlines a contract dispute centered around a rewritten term.

Key Allegations:

  • Twitch changed Section 8(a)(i) of its Terms of Service from allowing use for "monetizing the Twitch Services" to "in connection with Twitch and/or its affiliates’ business."
  • A new recital states that by streaming, users grant Twitch permission to cache and store their content.
  • The plaintiff, Warren Pandiscia (a long-time Twitch streamer with over 900 followers), argues the amended terms do not reflect the original agreement regarding user data use.

Supporting Arguments:

  • The complaint cites sections 7 and 10 of Twitch’s Terms of Service, which prohibit data mining and automated access, respectively, as supporting evidence.
  • It notes that Twitch’s privacy notice updated on January 15, 2026 did not mention AI training as a use for user data.
  • The revised privacy notice, added on August 12th, explicitly states Twitch uses user information "to test and improve technology, including machine learning and artificial intelligence" and "using data to develop or deploy our generative AI models and services."

Plaintiff’s Background:

Warren Pandiscia, a Connecticut resident, streams building LEGO sets and playing video games on Twitch for over 9 years. He claims to have invested tens of thousands of dollars in equipment, props, and subscriptions. He opted out after discovering the AI opt-out setting. Twitch’s Defense (Quote):

The complaint quotes Mike Minton, Twitch’s chief product officer, stating that they are "enrolling everyone so we can build a better future for streaming."
